Storage Rules & Responsibilities

Introduction
This page provides an overview of the expectations and responsibilities for storing your property at Ben's Farm – Storage. These are guidelines to help you understand what to expect. Your written storage agreement is the official and controlling document.
What We Provide
Ben's Farm – Storage provides outdoor gravel pad storage, pole barn indoor cold storage, and shop building indoor cold storage on private property near Thompson, ND.
Storage is provided on private rural land with the following features:
- Outdoor gravel pad with good drainage and wind shelter
- Pole barn indoor cold storage for smaller units
- Shop building indoor cold storage for larger RVs
- 24-hour recorded surveillance on all storage areas
- Access is generally by appointment or agreed hours
Your Responsibilities
As a storage customer, you agree to:
- Maintain Valid Insurance: You must carry your own comprehensive insurance on all stored property (vehicle, trailer, boat, equipment). Ben's Farm – Storage does not provide insurance coverage.
- Keep Your Space Tidy: Do not leave trash, fluids, or debris around your storage space. Clean up any spills immediately.
- Follow All Rules: Comply with all posted rules, written agreement terms, and instructions from property management.
- No Residential Use: You may not live in, camp in, or use any stored unit as a residence.
- No Hazardous Materials: No storage of flammable liquids (beyond normal fuel in tanks), explosives, toxic chemicals, or other hazardous materials.
- No Unauthorized Repairs: You may not perform large mechanical repairs, welding, painting, or other heavy work on-site without prior written approval.
- No Open Flames: No smoking, open flames, or unattended heaters on the premises.
- Winterization Required: For indoor winter storage, units must be winterized before arrival.
- Remove Propane and Fuel: Propane tanks and loose fuel containers must be removed before storage.
Payment, Minimum Term & Late Fees
Storage fees and payment terms are governed by your written storage agreement. General guidelines:
- Monthly Billing: Storage fees are billed monthly according to the rate sheet or written agreement.
- Minimum Seasonal Term: A minimum seasonal rental term applies—typically five months for winter storage.
- Prepayment Required: The first several months' rent (for example, five months for winter storage) is due up front at signing for seasonal storage.
- Month-to-Month Extensions: After the initial seasonal term, storage usually continues month-to-month unless otherwise specified.
- Late Fees: Late fees may apply if payment is not received by the due date as specified in your agreement.
- Non-Payment: If your account becomes significantly past due, we reserve the right to restrict access to your stored property and, if necessary, pursue legal remedies including removal of stored items and liens as permitted by North Dakota law.
The written agreement explains late fees, notice timing, and how non-payment is handled in detail.
Removing Your Property
Your storage agreement may include specific deadlines to remove property (for example, by a certain date at the end of the winter season or by the end of a paid rental period).
- End-of-Season Removal: If you do not wish to continue storage, you must remove all property by the deadline specified in your agreement.
- Late Removal Fees: If property is not removed on time, additional daily charges or transfer to another facility at the renter's expense may apply.
- Abandoned Property: Property left beyond agreed deadlines may be considered abandoned and subject to removal, storage at another facility, or disposal in accordance with North Dakota law.
Exact dates, charges, and procedures are defined in your signed agreement.
Liability and Insurance
Ben's Farm – Storage does not provide insurance coverage for stored property.
You acknowledge and agree that:
- Storage is at your own risk.
- You are solely responsible for insuring your property against theft, damage, weather, fire, pests, vandalism, and other risks.
- Ben's Farm – Storage is not responsible for loss or damage to your property from any cause, including but not limited to: weather, theft, vandalism, fire, animals, acts of third parties, or events beyond our control.
- You are responsible for removing loose valuables and personal items before storing your unit.
- You will hold Ben's Farm – Storage harmless from any claims, damages, or liabilities arising from your use of the storage space or your stored property.
Prohibited Uses
The following activities are strictly prohibited:
- Living in, camping in, or using any stored unit as a residence
- Any illegal activity of any kind
- Storage of hazardous or explosive materials (beyond normal fuel in vehicle tanks)
- Major mechanical repairs, welding, painting, or heavy work without prior written permission
- Subleasing or renting your storage space to another party
- Abandoning property without proper notice and removal
Access & Hours
Access to the storage property is typically by appointment or during agreed hours as specified in your storage agreement. Specific access arrangements (gate codes, lock codes, key access) will be provided based on your storage location.
Please coordinate with Benjamin Huffman in advance if you need access outside normal hours or have special access needs.
Changes to Storage Rules
We reserve the right to update these storage rules at any time. Material changes will be communicated to current customers. Continued use of storage services after changes constitutes acceptance of the updated rules.
Governing Law
Any storage agreement is governed by the laws of the State of North Dakota.
